Between BODIFYLAB (sole proprietorship, registered with the Nanterre Trade and Companies Register under number 890718661, registered office: 15 Allée Etienne Cabet, 92000 Nanterre — contact: infos@bodifylab.com / +33 7 80 98 28 84, hereinafter “BODIFYLAB” or the “Seller”), and the end customer, any adult individual wishing to make a purchase through the website https://www.bodifylab.com, referred to as the “Client” or the “Consumer”.

Article 1 — Purpose

These General Terms and Conditions of Sale (GTCS) are intended to define the rights and obligations of the parties in connection with the distance sale of products and programs offered by BODIFYLAB through its e-commerce website.

They apply to all orders placed by a Client acting for non-professional purposes.

Article 2 — Acceptance of the General Terms and Conditions of Sale

The Client’s validation of the order constitutes unreserved acceptance of these General Terms and Conditions of Sale, as well as of the choices made therein (products, prices, delivery methods, timeframes, etc.).

Article 3 — Products and services

3.1 Products offered

BODIFYLAB sells:

cosmetics (creams, oils, care products)
food supplements (syrups, capsules, powders, teas)
accompanied programs (3-month box + coaching + content and gifts)

The products are described as accurately as possible (composition, use, contents and any contraindications).

3.2 Compliance

All products comply with applicable French and European regulations and with mandatory statements and claims. The products are intended for the use described on the website.

Use must comply with the dosages, recommendations and contraindications indicated.

Article 4 — Prices

Prices are stated in euros (€), including all taxes (VAT included). They may also be displayed in other currencies depending on the Client’s country.

They include the applicable French VAT in effect on the date of the order.

Processing, preparation and delivery costs are displayed in addition before the order is validated.

BODIFYLAB reserves the right to change its prices; however, ordered products remain invoiced based on the prices in effect when the Client validates the order.

Article 5 — Orders

5.1 Ordering

The Customer places an order via the website by creating an account or as a guest. The order form summarizes: the products selected, the quantities, the prices, the delivery fees, and the payment terms.

5.2 Validation

The order is considered definitively validated upon receipt of full payment, including processing and delivery fees.

BODIFYLAB confirms each order by email, containing the summary and tracking number.

Article 6 — Payment Terms

Payments are made via the website’s secure solutions: bank card (Visa, MasterCard, etc.), 3x / 4x payment, and secure third-party payment solutions (Stripe, PayPal, Klarna, Scalapay, etc.).

The Customer’s account is charged immediately upon order validation.

All transactions are encrypted via a secure protocol (HTTPS).

Article 7 — Delivery

7.1 Areas Served

Deliveries are made within metropolitan France, the overseas departments and territories, and areas served by the carrier indicated when the order is placed.

7.2 Delivery Times

Standard: 3 to 7 business days. Express: 24 to 72 hours depending on the options. Delivery times may be longer for international deliveries.

Any reasonable and justified delays shall not give rise to cancellation or compensation.

7.3 Transfer of Risk

The risks of loss of or damage to the products shall transfer to the Customer upon handover to the carrier.

Article 8 — Right of Withdrawal

In accordance with Article L221-18 of the French Consumer Code, the Customer has a period of 14 calendar days from receipt of the product(s) to exercise their right of withdrawal, without stating a reason.

The Customer must inform BODIFYLAB via the contact form or by email at: infos@bodifylab.com, specifying: first and last name, order number, and the products concerned.

Products must be returned intact, unopened, and in their original packaging.

Return costs shall be borne by the Customer, except in the event of a delivery error.

Eligibility condition: To be eligible for a return, your item must be unused and in the same condition as when you received it. It must also be in its original packaging and must not have been used or touched for hygiene reasons.

Article 9 — Returns, Exchanges & Refunds

9.1 Defective Products

In the event of a damaged or non-conforming product, the Customer shall inform BODIFYLAB within 48 hours of receipt, with a photograph of the product.

BODIFYLAB offers: exchange, refund, or store credit.

9.2 Used Products

Opened or used products cannot be returned, except in the event of a proven defect covered by the legal guarantee.

Article 10 — Legal Guarantee

10.1 Legality & Compliance

BODIFYLAB guarantees that the products conform to the description on the website and are free from hidden defects, in accordance with Articles L.217-4 et seq. of the French Consumer Code.

10.2 Liability

BODIFYLAB shall not be held liable in the event of improper use, personal allergy or intolerance, or failure to comply with the instructions.

Article 11 — 90-Day Program & Coaching

Programs with support (box + coaching) are services in their own right.

11.1 BODIFYLAB’s Commitment:

provide the monthly boxes according to the chosen objective
provide personalized monthly coaching
provide the included guides and content

11.2 Customer’s Commitment:

comply with the usage instructions
be reachable for follow-up
not distribute or resell the exclusive content

11.3 Program Refund Conditions: For any program that has begun, the refund conditions are defined in the specific program contract. As a general rule, except in cases of force majeure, no full refund may be required for a program that has already begun.

Article 11A — THE BODIFYLAB METHOD™ Booking and Refund Right

Art. 11A.1 — Nature of the Booking: The €80 booking made as part of the pre-order of THE BODIFYLAB METHOD™ constitutes a deposit within the meaning of Article 1590 of the French Civil Code, guaranteeing the allocation of a place in Le Cercle BODIFYLAB, limited to 200 members.

Art. 11A.2 — Withdrawal Period and Full Refund: In accordance with Article L221-18 of the French Consumer Code, the Customer has a 14-day right of withdrawal from the booking date. Beyond the statutory withdrawal period, BODIFYLAB grants an extended refund period until and including July 17, 2026. During this period, the Customer may request a full refund of their booking by simple written request to infos@bodifylab.com, without having to provide a reason.

Art. 11A.3 — Firm and Final Nature as of July 18, 2026: As of July 18, 2026, the reservation becomes firm and final. This date corresponds to the finalization of the Circle members' personalized files by BODIFYLAB advisors. Pursuant to Article L221-28 of the Consumer Code, the right of withdrawal may no longer be exercised for goods made to the consumer's specifications or clearly personalized.

Art. 11A.4 — Refund Terms: Any approved refund shall be processed within a maximum of 14 days from receipt of the request, using the original payment method used for the reservation.

Art. 11A.5 — Deduction upon Launch: Upon the official launch of the program on August 1, 2026, the sum of €80 paid as a reservation fee shall be deducted in full from the final price of the Client's personalized program. If the Client does not finalize the order within 30 days following the public opening, the reservation shall be deemed void and the sum of €80 shall remain vested in BODIFYLAB as a lump-sum indemnity.

Article 12 — Protection of Personal Data (GDPR)

The data collected is necessary for order processing, billing, customer relations and follow-up.

BODIFYLAB undertakes to:

comply with the GDPR (data stored securely)
not resell the data
allow access to, rectification and deletion of the data

Article 13 — Intellectual Property

All elements of the website (texts, images, logos, videos, designs) remain the exclusive property of BODIFYLAB.

Any reproduction or use without authorization is prohibited.

Article 14 — Force Majeure

The Seller shall not be held liable if performance of the order is delayed or prevented by an external, unforeseeable and unavoidable event (strike, disasters, etc.).
